SERAP Takes Akpabio, Others To Court For Allegedly Collecting Salaries, Pensions

Socio-Economic Rights and Accountability Project (SERAP) has initiated legal proceedings against Senate President Godswill Akpabio and nine other former governors from the 10th Senate. This legal action is in response to their simultaneous receipt of both senatorial salaries and pensions.

Joined in the suit as Respondents are the following: Abdulaziz Yari; Aminu Tambuwal; Adamu Aliero; Adams Oshiomole; Ibrahim Gaidam; Seriake Dickson; Ibrahim Dankwambo; Aliyu Wammako; Gbenga Daniel, and Dave Umahi.

In the suit number FHC/ABJ/CS/1360/2023 filed last Friday at the Federal High Court in Abuja, SERAP is seeking: “an order of mandamus to direct and compel Mr Akpabio, nine other senators and Mr Umahi to stop collecting both salaries and pensions, and to return any pensions collected to their respective state treasuries.”

The organization is also seeking an order of mandamus to direct and compel Mr Akpabio, nine other senators and Mr Umahi to clarify and disclose if they have collected and/or currently collecting both salaries and pensions as former governors.

In the suit, SERAP is arguing that: “The Seventh Schedule to the Nigerian Constitution 1999 (as amended) requires the former governors to stop collecting both salaries and pensions and to return any pensions collected.”

SERAP is arguing that, “Unless the reliefs sought are granted, the former governors would continue to both enjoy life pension packages, and collect salaries as serving public officers, and the travesty and private self-interest would continue.”

The suit filed on behalf of SERAP by its lawyers, Kolawole Oluwadare and Ms Valentina Adegoke, read in part: “The UN Convention against Corruption requires public officials to discharge a public duty truthfully and faithfully.

“The UN Convention also implicitly prohibits large severance benefits for public officials. The convention specifically in article 8 requires public officers to promote integrity and responsibility in the management of public resources.

“Paragraph 2 (a) of the Code of Conduct for Public Officers in the Fifth Schedule, Part 1 of the Nigerian Constitution provides in part: ‘a public officer shall not receive or be paid the emoluments of any public office at the same time as he receives or is paid the emoluments of any other public office.’

“According to reports, there are fourteen former governors in the Senate and as ministers who may be collecting pensions running into billions of naira from their states. The former governors include: Godswill Akpabio (Akwa-Ibom State); Adams Oshiomhole (Edo State); Adamu Aliero (Kebbi State); Dave Umahi (Ebonyi State); Aminu Tambuwal (Sokoto State); and Abubakar Sani Bello (Niger State).

“Others are: Ibrahim Danwkambo (Gombe State); Danjuma Goje (Gombe State); Abdulaziz Yari (Zamfara State); Gbenga Daniel (Ogun State); Aliyu Wammako (Sokoto State); Orji Kalu (Abia State); Ibrahim Gaidam (Yobe State); and Seriake Dickson (Bayelsa State). Also, there are at least seven former governors in President Bola Tinubu’s cabinet who may be collecting both salaries and pensions.”

No date has been fixed for the hearing of the suit.

Victor Osimhen, the Super Eagles forward, has revealed that buying a house for his late father, James Osimhen is one of his greatest achievements.

He said he bought the house with the first money he made from football.

The Napoli talismanic striker said he is sure his late parents are proud of him.

The 24-year-old stated this in a recent chat with YouTuber, Korty EO.

He said, “God gives, and he takes. I lost my mum a long time ago. And I lost my father in 2020. But I know that they are proud of me.

“The first time I received my first money in football, I bought a house for my father. So, that’s one of the greatest achievements for me.

“To carry the name of the family on my shoulders, it’s actually not an easy thing. You got some attacking you spiritually. Some hating on you physically. And some backstabbing you. Because they prefer money to life, but it’s just God that’s keeping me.”

Why I Dropped Out Of University In My Final Year – Oxlade

Ikuforiji Olaitan Abdulrahman, the sensational Nigerian singer, who is popularly known as Oxlade, has revealed why he abandoned his university degree programme in his final year.

The ‘Ku Lo Sa’ crooner said he was studying at Lagos State University, LASU, but dropped out in his final year because some cultists were after his life.

He said the cultists were pressuring him to join their gang but he declined and fled the campus.

He disclosed this in the latest episode of the Tea With Tay podcast, hosted by actor, Temisan Emmanuel Ahwieh, aka Taymesan.

Oxlade said, “During my university days, I was always in the church reading bible and books. Then I dropped out in my final year.

“I’ve never said this before. I dropped out when some boy were trying to make me join gang. One day, my grandma called me asking where I am. I said I was in campus and she said I should start coming to our family home in Ibadan.

“I went to Ibadan. That day, those cultists, they almost killed my roommates. That’s why I appreciate my grandma’s importance in my life. Truly, there’s God. And I’m saying this with my full chest, God has saved me countless times.”

Mohbad Was Never Arrested By NDLEA, Says Spokesman

The National Drug Law Enforcement Agency has spoken about the late singer, Ilerioluwa Aloba, aka Mohbad.

The agency said that contrary to reports that went viral in the media and online, Mohbad was never arrested by the agency.

The spokesperson for the NDLEA, Femi Babafemi, said, “We also heard the unsubstantiated allegation on social media that Ilerioluwa Aloba, aka Mohbad, was arrested and detained by the NDLEA on February 24, 2022, and given a substance to drink. In response to this allegation, we wish to state categorically that Mohbad was never arrested; neither was he ever detained in the custody of the NDLEA on the said date or any other date before or after. The foregoing being the case, the issue of giving him any substance to drink does not arise.”

The NDLEA also stated that contrary to a claim by the Lagos State Commissioner of Police, Idowu Owohunwa, that the police were expecting feedback from the anti-narcotics agency over an inquiry into the singer’s death, it had responded to the police’s inquiry since September 28, 2023.

In a letter dated September 28, and signed by the Deputy Commander-General of Narcotics, Josephine Obi, which was obtained by our correspondent on Saturday, the NDLEA categorically informed the police that Mohbad was neither arrested nor detained in the custody of the agency.

Babafemi added, “Following media inquiries on the claim by the Lagos State Police Command at a press conference on Friday, October 6, 2023, that it was yet to get a response from the NDLEA on social media allegations bordering on alleged arrest and detention of the late artiste, the agency will like to state that indeed, its response was sent and received by the police since Thursday, September 28, 2023.

“Indeed, to show the seriousness with which the agency treated the issue, our formal response dated Thursday, September 28, 2023, was sent by flight to Lagos, delivered and received by the police on the same day.”

While briefing the media on the results of the police’s investigation so far on Friday, October 6, Owohunwa said, “While re-assuring that the command will sustain its firm determination to ensure justice in this case, I wish to assure that the members of the public will be availed of any further development in relation to the outcomes of the autopsy and toxicology reports, DPP advice, feedback from NDLEA and any other development in the investigation into this case.”

How Fans Contributed To Mohbad’s Problems – Ruger

Michael Adebayo Olayinka, the popular Nigerian singer, who is professionally known as Ruger has narrated how the followers of the late singer, Mohbad contributed to his death.

Mohbad, a former signee of the Marlian Record label owned by Naira Marley died on Tuesday September 12, 2023, in a controversial manner.

Naira Marley and his associate, Sam Larry were accused of having a hand in Mohbad’s sudden death after a series of documents and videos of the duo subjecting Mohbad to a relentless bullying for leaving the Record label surfaced on social media.

However, speaking in his latest interview with UK-based media personality, Adesope Olajide on ‘Afrobeats Podcast’, Ruger blamed fans for complicating issues for Mohbad before his death.

He accused the late singer’s fans of not supporting him when he parted ways with the record label.

“I don’t know whether the label was Mohbad’s problem or not. I just want you all to know that the label was not only his problem, but the fans were his problem too.

“Because as soon as he left the label, I don’t think people continued listening to him anymore. I feel like they were just attached to the fact that he was a Marlian,” he said.

Throwing Stones But You Live In Glass House – Davido Responds To Pinnick’s Allegations

David Adeleke, the world-famous Nigerian singer, who is also known as Davido, has seemingly responded an allegations by former President of the Nigeria Football Federation, Amaju Pinnick.

He seemingly responded to the allegations by Pinnick that he refused to show up at an event in Warri, Delta State, despite being paid an excess of $94,600 (about N72 million).

Recall that Pinnick recently called out Davido for refusing to perform at this year’s Warri Again festival despite allegedly receiving a payment of $94,600 and the organisers booking a private jet for him for $18,000.

He threatened to teach the singer a lesson, adding that he was becoming too proud despite not being a bigger artist than Burna Boy who is half Itsekiri (Warri).

In what appears like a shade on the former boss of the Glass House; NFF headquarters, Davido wrote via his X handle, “Throwing stones but u dey live for glass house.”

In another post, Davido bragged that nobody could stop him from performing anywhere in Nigeria, assuring his fans in Warri that he would be in their city soon.

“Nobody can stop me from performing anywhere in Nigeria… Warri I will see you soon,” he wrote.

He also posted a picture of the Nigeria Football Federation, NFF, logo with the caption; “Make I no talk.”

Marketers Raise The Alarm Over Lightness Of Petrol

An alarm has been raised by marketers of the Premium Motor Spirit (PMS) petrol over the lightness of the product in some retail outlets, noting that it is inferior to the quality the Nigerian Midstream and Upstream Regulatory Authority (NMDPRA) approved, The Nation reports.

They described some of the products imported to Nigeria as evaporating and undurable.

The Independent Petroleum Marketers Association of Nigeria (IPMAN), National Vice President, Mr. John Keke Ocha, broke the news at Natural Oil and Gas Suppliers Association of Nigeria (NOGASA)  National Executive Council (NEC) in Abuja.

According to him, lack of adequate legitimate domestic refining of petroleum has paved the way for the importation of all manners of products to meet consumer needs.

Explaining that absence of in – country refining has led to the importation of different grades of petrol, he lamented that the consumers have no choice.

He advised the Federal Government to look inward to ensure the national and private refineries are functional.

His words: “The prayer of this house is that government must look inward to ensure our refineries are put to use to create room for reduction of these high petroleum products importation as we are saying today.

“A lot of people don’t use their vehicles again. If you put N20,000 or N30,000 fuel in your car, before two days the thing is gone. I don’t know whether it is evaporating. “Sometimes, I ask myself what has happened to the N30,000 fuel that I bought yesterday. The thing (fuel gauge) has started showing red. 

“I don’t know if the type of product we have is no more like the original product that we used to get. 

“This is because the competition has made it convenient for importers to get very light and all kinds of product to the country. And we accommodate it because we don’t have alternative. 

“But if we produce it in this country, we will have choice. If we produce in this country, we will select. If we produce in this country, it will make it even more competitive and cheaper. 

“That is the prayer of this house: the government must look inward and make life easy for people by making sure refineries are put in place to function.”

But the NMDPRA Corporate Communnications General Manager, Mr. Kimchi Apollo was not reachable on phone to state the Authority’s side of the story.

Nigerian Police Arrest Six Students Of Federal University, Katsina After One Died During Clash Over Girlfriend

Abubakar Nasiru Barda, a student of the Federal University Dutsin-Ma in Katsina State, has been killed in a rival clash over a girlfriend, SaharaReporters has gathered.

The tragic incident and the abduction of five female students are among security challenges faced by the university.

Barda was reportedly killed after a bitter altercation over a girlfriend involving two rival groups, according a police report.

The spokesperson for the Katsina State Police Command, ASP Abubakar Sadiq Aliyu, on Saturday confirmed the arrest of six suspects in connection to the violent clash that claimed the life of Barda.

He said, “On September 28, 2023, at about 1320 hrs, a tragic incident occurred at Darawa quarters, Dutsinma LGA, Katsina State, involving eight (8) students of the Federal University Dutsinma. The incident was the result of a heated altercation between the students over a relationship with a fellow female student, which escalated tragically, leading to the death of one of the students involved.

“The Command takes this matter very seriously and is currently conducting a thorough investigation to determine the facts surrounding the incident, as six (6) of the students in connection with the incident have been arrested.

“We are working diligently to gather and analyze all available evidence, including eyewitness testimonies, with the aim of establishing a comprehensive understanding of the events that transpired while upholding the principles of justice and fairness.

“As the investigation progresses, updates will be shared with the public to ensure transparency. We encourage any individual with relevant information about the incident that will assist the investigation to step forward, as all information received will be treated with the utmost confidentiality.”

In the same vein, the Vice -Chancellor of the university, Prof. Armaya`u Hamisu Bichi who also confirmed the incident said the institution would sanction the affected students.

Bichi, while receiving the report of a committee on the matter, vowed to fully implement all the recommendations of the Ad hoc committee that investigated the circumstances that led to the death of the 200 level Computer Science and Information Technology, student.

“The university management has been up and doing since the occurrence of the unfortunate incident to ensure justice is served to all.

“A preliminary report submitted to the management by the committee revealed that the unfortunate incident occurred outside the university’s campus but upon receipt of information university Security were quickly mobilised to the scene for prompt intervention that halted further altercation between the students and apprehension of some students involved.

“The matter has already been taken over by police which led to the arrest of six students that are in connection with the incident as confirmed by the police official press statement,” Bichi said.

Atiku Finally Approaches Supreme Court, Files Fresh Evidence Against Tinubu’s Victory

Atiku Abubakar, the presidential candidate of the Peoples Democratic Party, PDP, has finally filed fresh evidence at the Supreme Court of Nigeria against the qualifications of President Bola Ahmed Tinubu in the February 25, 2023 presidential election.

Atiku, a former Vice President, said in the fresh evidence that he is categorically and authoritatively asserting that the Diploma Certificate of the Chicago State University (CSU) used by Tinubu to secure qualifications for participation in the election is fake, having been allegedly forged.

In a motion on notice filed by his legal team headed by Chris Uche SAN, Atiku asked the Supreme Court to invoke its Order 2 Rule 12 of 1985 to admit the fresh evidence of certificate forgery and perjury in support of his pending appeal before the Court to do substantial justice to his case.

Atiku, in the motion, marked SC/CV/935/2023, prayed the Apex Court to grant him leave to produce the additional evidence and for the Court to receive the fresh evidence from him.

Respondents in the motion are the Independent National Electoral Commission, INEC; Bola Ahmed Tinubu and the All Progressives Congress, APC, as 1st to 3rd respectively.

The motion is predicated on several grounds but mainly on the release of academic records of Tinubu, evidence of the Registrar of the Chicago State University before a United States of America Court and the deposition of the same witness in respect of the Diploma Certificate President Tinubu presented to INEC for the purpose of eligibility for the election.

Other grounds in the motion are that “The 2nd Respondent (Tinubu) was not qualified at the time of the election to contest the election as required by Section 137 (1) (j) of the Constitution of the Federal Republic of Nigeria 1999 (as amended).

“Based on facts available to the Appellants/Applicants (Atiku) at the time of filing their Petition, the 1st Appellar Applicant (Atiku Abubakar,) through his United States of

American lawyers, Alexander de Cmmont and Argela M. Liu of the law firm of Dechert LLP o11900 K Street, NW, Washington DC 20006-1110, unsuccessfully applied to Chicago State University for the release of copies of the academic records of the 2nd Respondent.

“Given the strict privacy laws in the jurisdiction of Chicago State University, the request for the release of the academic records and certificate issued to the 2nd Respondent could not be granted without an order of court and for the purpose of use in pending court proceedings.

“The 1st Applicant through his said US-based Attomeys thereupon brought an action in the U.S. District Court for the Northern District of Illinois -In rc: Application of Atiku Abubakar for an Order Directing Discovery from Chicago State University Case No. 23-CV-05099 for an order for the production of documents and testimony for use in a proceeding in a foreign court, seeking documents and testimony from Chicago State University concerning the authenticity and origin of documents purporting to be the educational records of the 2nd Respondent, Bola A. Tinubu.

“The 2nd Respondent (Tinubu) applied and was joined in the matter as an Intervenor, vehemently opposed rhe application.

“On September 19, 2023, the Court issued an order granting the application and

thereafter, the 2nd Respondent applied for an emergency stay of the Court Order, claiming that he would suffer irreparable damage and injury if his educational records were released: which order of stay was granted.

“On September 30, 2023, the Court overruled the 2nd Respondent’s objections and ordered Chicago State University to produce tbe documents on October 2, 2023, and to produce a witness for deposition on October 3, 2023.

“On October 2, 2023. Chicago State University produced the documents pursuant to the Court’s Order.

“On October 3, 2023, also pursuant to the Court’s Order, Chicago State University provided a witness to give deposition testimony, in which deposition, Chicago State University disclaimed ownership and

authorship of the document that the 2nd Respondent presented to INEC, purporting to be “Chicago State University certificate” and also disclaimed issuing any replacement certificate to him.

“The deposition was not in existence or available at the time of filing the petition.

“The deposition sought to be adduced is, along with its accompanying documents, such as would have important effect in the resolution of this appeal.

“The deposition is relevant to this matter, having confirmed that the certificate presented by the 2nd Respondent to the Independent National Electoral Commission (INEC) did not emanate from Chicago State

University, and that whoever issued the certificate presented by the 2nd Respondent, did not have the authority of the Chicago State University, and that the 2nd Respondent never applied for any replacement certificate nor was he issued any replacement certificate by the Chicago State University.

“The deposition, which is on oath and deposed to in the presence of the 2nd Respondent’s Attorney, is credible and believable and ought to be believed.

“The deposition is clear and unambiguous, and no further evidence is needed to be adduced on it. The evidence is such that could not have been obtained without reasonable diligence for use at the trial, as the deposition required the commencement of the suit in the United States of America before receiving same. It is not possible to obtain the said evidence before the trial at the Court below.

“The deposition was made on October 03, 2Q23 after the conclusion of trial at the Court below, and was not available to be tendered at the trial.

“Presentation of a forged certificate to the lndependent National Electoral Commission by a candidate in an election to the office of President of the Federal Republic of Nigeria is a weighty constitutional matter,

requiring consideration by the Courts as custodians of the Constitution.

“The original certified deposition has been forwarded to the Honourable Court by a letter addressed to the Chief Registrar of the Supreme Court

“It is in the interest of justice for the Honourable Court to exercise its discretion in favour of the Appellants/Applicants.”

The motion was supported by several paragraph affidavit deposed to on behalf of Atiku and PDP by one Uyi Giwa-Osagie, a legal practitioner of Plot 120, Adetokunbo Ademola Crescent, Wuse II, Abuja.

It read in part, “That the 1st Appellant/Applicant contested the election to the ofiice of the President of the Federal Republic of Nigeria on the platform of the 2nd Appellant/Applicant, which election was conducted by the 1st Respondent on the 25th day of February 2023.

“That the 1st Respondent retumed the 2nd Respondent as the winner of the said election, and hence the Appellants, beirg dissatisfied with the retum, filed a Petition on the 21st day of March 2023 before the Court of Appeal sitting as the Presidential Election Petition Count.

“That the Court below had by a judgment delivered on 6th September 2023

dismissed the said Petition, whereupon the Appellants/Applicants appealed against the said judgment to this Honourable Court in September 2023.

“That the Record of Appeal has been transmitted to this Honourable Court and the appeal duly entered, and the said Record ofAppeal is now before this Honourable Court, running into over 9,000 pages in 11 Volumes, upon which the Appellants/Applicarts are relying in this application.

“That I know that one of the grounds of the Appellants/Applicants’ Petition before the Court below is that the 2nd Respondent (Tinubu) was not qualified at the time of the election to contest the election and did not meet the constitutiolal theshold to contest.”

Meanwhile, no date has yet been fixed for hearing of the motion.

Joey Akan, the popular Nigerian journalist, has backed the police report on how singer Mohbad died.

In a tweet he shared, Joey Akan said the police report confirmed all he knows about Mohbad’s death. He went on to outline how Mohbad died.

The journalist tweeted; “Nigerian police finally confirms all I know about Mohbad’s death:

* Sustained an injury during a fight with his childhood friend at a branded experiential marketing show/activation in Ikorodu to market a product

* Instead of going to his hospital, his friends and handlers called in a quack nurse to “disinfect” the wound.

* Nurse gives him a cocktail of intravenous injections, he collapses. Everyone panics and starts rushing him to the hospital they should have gone in the first place.

*Hospital rejects him because he was already dead.

* Friends then make a video of his lifeless body, crudely announcing his death before even family is alerted. Really sad way to go for a person with enough resources that get the best care in the world.”
