Nigeria’s President, Mr. Bola Tinubu, has said the appeal by the presidential candidate of the Labour Party, Peter Obi, is lacking in merit, substance and good faith.
Tinubu who said Obi’s appeal which was based on allegations dismissed at the election petition tribunal, argued that the presidential election was peacefully conducted all over the country, and the results of elections were carefully and accurately recorded in the various forms of EC8As.
This was contained in a response by his lead counsel, Wole Olanipekun, SAN, to the appeal filed by Obi challenging the decision of the tribunal.
He said, ”The entire petition was nothing but a jamboree of sorts, which was prosecuted more in the media than in the courtroom and the lower court, being a court of law and not of sentiments, dutifully threw away their petition after a painstaking consideration of same.
if considered from every angle, is lacking in merit, substance, and good faith.
“Be it noted that, unlike previous election petitions over which this honourable court has presided (in time past) and made far-reaching pronouncements on diverse issues, including but not limited to ballot box snatching, vote buying, voters’ intimidation, interference by the military, thuggery, ballot stuffing, violence, disenfranchisement, non-recording of votes in form EC8A, which is the building block or the base of the pyramid, and such other electoral vices, this appeal arising from a dismissed petition, the main grouse of which is that, while the presidential election was peacefully conducted all over the country, and results of elections carefully and accurately recorded in the various form EC8As, some unidentified and unspecified results, even in the appellants’ brief were not uploaded electronically to the IREV portal. ”
He noted that Obi failed to prove his allegations of non-compliance and corrupt practices as required by law.
Tinubu said, “Instructively, however, the lower court, appreciating that it is not a court of final instance, proceeded to determine the petition on its merit, while itemising several monumental failures of the petitioners to provide any evidence in support of their much-touted case.
“While affirming the election and declaration of the 2nd respondent at the referenced presidential election, the lower court also found that the appellants did not prove any of their allegations on the requisite standards of proof. ”
In his reply on the 25 percent requirement in the FCT, Tinubu told the apex court that Obi was on a “fishing expedition”.
He said, “The other very remote contention is that the 2nd respondent did not score 25 percent of the votes recorded at the Federal Capital Territory.
“With much respect to the appellants, the petition is more of a fishing expedition; much more of evocation of thunder without dews. ”
Tinubu, however, said the tribunal judgment was in order, adding that, “It is against the well-considered judgment of the lower court that the appellants have brought this appeal.”
Senator Bashiru Ajibola, the National Secretary of the All Progressives Congress (APC), has stated that the presidetial candidates of the Peoples Democratic Party (PDP), and Labour Party, Atiku Abubakar and Peter Obi should be charged with treason.
Recall that Obi had during a press conference on Wednesday in Abuja asked Tinubu to reintroduce himself to Nigerians and clarify the issues of his identity.
The LP flagbearer also asked President Tinubu to particularly disclose his real names, state of origin, and where he served when he did the National Youth Service Corps (NYSC).
Reacting to Obi’s press conference in an interview on Channels Television’s Politics Today on Wednesday, Ajibola said Tinubu does not need reintroduction because Nigerians are aware of his credentials.
The former Spokesman of the Senate said Atiku and Obi are suffering from the trauma of their electoral loss because they are serial losers, stressing that they need “psychiatrist evaluation”.
The APC scribe asserted that the former Vice President and the former Governor of Anambra State should be charged with treason for questioning the identity of the President.
But the APC said Nigerians are aware of Tinubu’s credentials, stressing there was no need for a new introduction.
He said: “Obi must know that President Tinubu does not need a re-introduction. He does not have any identity problem, except the one contrived by the Atikus and Peters of our political firmament.
“As for President Tinubu’s academic record at the Chicago State University, the facts are clear and settled except for those political jaundiced by the trauma of electoral defeat.
“I think Atiku and Obi should be charged with treason for questioning the identity of President Bola Ahmed Tinubu.”
The candidate of the Labour Party (LP) in the 2023 presidential election, Peter Obi, has shunned the invitation by his Peoples Democratic Party counterpart in the poll, Atiku Abubakar, to join him to secure justice.
Atiku on Thursday called on his co-contestants on the platforms of the Labour Party, Obi; and the New Nigeria Peoples Party, Rabiu Kwankwaso, to join his quest in making President Bola Tinubu account for his forgery of Chicago State University certificate.
Atiku said this at a world press conference in Abuja, two days after his lawyers through a United States court obtained the academic records of Tinubu from the Chicago State University (CSU) which showed alleged discrepancies with what the sitting Nigerian president submitted to the Independent National Electoral Commission before the February election.
Both Atiku and Obi challenged Tinubu’s election at the Presidential Election Tribunal Court, for months before the tribunal overturned the cases and affirmed the president’s victory.
Meanwhile, both candidates have appealed the dismissal of their petitions at the Supreme Court, with the PDP candidate hoping to use the alleged forged certificate as a strong case against Tinubu in his appeal.
Speaking at the conference, Atiku said, “This quest is not for or about Atiku Abubakar. It is a quest for the enthronement of truth, morality, and accountability in our public affairs.
“In line with this, therefore, I am calling on all well-meaning Nigerians, leaders of thought, our religious leaders, our traditional leaders, our community leaders, our political leaders, and in particular, Governor Peter Obi of the Labour Party and Governor Rabiu Kwankwaso of the NNPP and, the leaders of every political party in Nigeria, and, indeed, every single person who loves this country, as I do, and who wishes nothing but the best for the country, as I do, to join me in this campaign to enshrine probity, accountability and the basic principles of justice, morality and uprightness in our country and in our government. This is a task for each and every one of us.
However, the former Anambra governor, in a statement issued by Labour Party National Publicity Secretary, Obiora Ifoh, said he was “focused” on “reclaiming his mandate” at the Supreme Court, according to a statement obtained by The Nation.
In turn, he welcomed others to join in their (Obi and LP) pursuit of justice in the country.
The statement said: “The presidential candidate of the Labour Party, Peter Obi is presently in the Supreme Court seeking to reclaim his stolen mandate and he is focused on that.
“He has been in the vanguard of ensuring a just nation where justice must be the watchword, and he will not stop until Nigeria achieves a leadership it truly deserves.
“Obi has pontificated severally on the need for leaders to be good role models and to live a life worthy of emulation. This he has done by publicly putting his credentials in the open for verification. Nigeria will get better when men of integrity and honour drive the affairs of the nation.
“We therefore welcome every other interest willing to join us in our pursuit of a nation where justice shall reign.”
The Labour Party (LP) and its presidential candidate, Peter Obi, have filed a brief of arguments at the Supreme Court, in furtherance of the petition challenging the win of President Bola Tinubu in the February 25 polls.
The development was disclosed in a post via the X platform early on Tuesday morning by actor and chieftain of the party, Kenneth Okonkwo.
He wrote: “To God be the glory, we have filed our Appellants’ Brief of Arguments at the Supreme Court of Nigeria. We still trust in God to see us through. Great kudos to all the members of the Presidential Petition Legal Team of @PeterObi. God will bless all of them.”
According to a part of the document seen by Naija News, the filing is an appeal against the judgement of the Court of Appeal delivered on 6th September 2023 in the petition filed by Obi and the Labour Party against Tinubu’s victory.
It added that the appeal is predicated on the notice of appeal filed on 19th September 2023 containing 51 grounds of appeal.
Listed as respondents in the case are the Independent National Electoral Commission (INEC), Senator Bola Ahmed Tinubu, Senator Kashim Shettima and the All Progressives Congress (APC).

Mr. Peter Obi,the Presidential Candidate of the Labour Party, LP, in the 2023 general elections, has said the security crisis ravaging the Southeast region can only be tackled if the leaders are united.
The former Anambra governor stated this in a message he delivered during the Southeast Summit on Economy and Security, in Owerri, the Imo state capital.
According to Obi, the people of the Southeast, who are predominantly businessmen, have gradually lost their sources of income due to criminal activities perpetrated by hoodlums in the zone.
The LP presidential candidate, whose message was aired at the summit, urged the leaders of the Southeast to come together and speak up on ways to end the embarrassing insecurity in the region.
He said, “This summit which is focusing merely on security and its economic impact on the Southeast has come at the most auspicious time. It’s very necessary that as a people we come together, and put our heads together to find a lasting solution to this problem of insecurity in our homeland.
“Our mainstay as a people is business, no business and indeed any other economic activity would thrive amid insecurity.
“If we put our minds to it and work in unity and mutual trust, we will find a way out of this problem that is alien to us.
“Let me therefore commend your excellencies, the governors of the Southeast for initiating the idea of the summit and working together to make this a reality.
“Let me urge everyone at this summit and those of us who are unable to attend in person to speak up, contribute ideas, and be part of the initiatives or actions that would be agreed upon at this summit to bring an end to the problem of insecurity in our region.
“God to guide us, grant us the wisdom, strength, and courage to take the necessary steps to end insecurity in our homeland so that we can continue to work with our God-given talent and energy to restore peace, tranquility in the Southeast and indeed our dear country Nigeria.”
