Tinubu Directs Ondo Assembly to Transfer Power to Deputy Governor, Aiyedatiwa

Nigeria’s President Bola Tinubu has ordered the Ondo State House of Assembly, to transfer power to deputy governor Lucky Aiyedatiwa
This is according to a report by The Nation.
The report alleged that Tinubu made this known at a meeting he summoned to resolve the leadership crisis in Ondo on Monday
The President emphasized that this transfer should be conducted without any conditions, as it aligns with the “Doctrine of Necessity.”
The Nation learnt the transfer of power will be done by electronic signature (e-signature) as the ailing governor is too weak to sign any document.
This decision allows Governor Akeredolu to take a medical leave, ensuring his well-being.

President Tinubu Summons Aiyedatiwa, Ondo Assembly Speaker To Meeting In Aso Rock

The Deputy Governor of Ondo State, Lucky Aiyedatiwa, and the State House of Assembly Speaker, Olamide Oladiji, were reportedly summoned by President Bola Tinubu to Aso Rock in Abuja for an urgent meeting.

The meeting, which would take place today, is to find a permanent solution to the political crisis in the South West State and address the leadership situation in the state.

Sources told SaharaReporters that Tinubu will ask that the deputy governor should be allowed to act as governor, to resolve the leadership crisis in the state.

The source said: “Tinubu has summoned the Ondo State Deputy Governor and the House Speaker to another urgent meeting after Sowore announced mass protests and town hall meeting in Akure.

“The emergency meeting is to be held in Aso Rock on Monday. It is aimed by Tinubu to ask the deputy governor to be allowed to act as governor.”

The emergency meeting will be the second one summoned by the President to resolve the leadership crisis in the state following the governor’s absence from office since July 2023.

The call for the meeting comes about two weeks after Tinubu met with Ondo stakeholders including Aiyedatiwa, his and aides of Governor Akeredolu, state commissioners, party chieftains and some elders of the state on November 24.

BREAKING: Tinubu Wades Into Akeredolu, Aiyedatiwa’s Feud

President Bola Tinubu has intervened in the conflict between Ondo Governor Oluwarotimi Akeredolu and Deputy Lucky Aiyedatiwa.

A source said President Tinubu has invited members of the Ondo Assembly to Abuja Friday.

Prominent elders and traditional rulers in the week appealed to President Tinubu to intervene in the political crisis to avert looming anarchy.

It was gathered the Ondo Assembly has been divided with 11 lawmakers now in support of Aiyedatiwa.

Sources said the 11 lawmakers were reached out to by some forces outside Ondo State.

A sitting of the lawmakers scheduled for Friday was said to have been pushed by the 11 lawmakers.

One of them, who pleaded anonymity, said the sitting was part of the plans hatched in Abuja with the 11 lawmakers to declare Governor Akeredolu incapacitated and declare Aiyedatiwa Governor.

Speaker Oladiji Olamide, who confirmed the meeting with President Tinubu, said the outcome of the meeting would determine the next line of action.

Oladiji said the scheduled Friday’s plenary was to declare Aiyedatiwa as Acting Governor and not to declare Akeredolu as incapacitated.

He said the meeting with President Tinubu would hold on Friday afternoon.

“Our sitting was to declare Aiyedatiwa as Acting Governor. The Governor is still alive,” he said.

BREAKING: Ondo Deputy Governor Apologizes To Akeredolu

Lucky Aiyedatiwa, the Deputy Governor of Ondo State, has tendered an apology to his principal, Governor Rotimi Akeredolu over their rift.

The embattled Deputy Governor made the apology when addressing a world press conference on Thursday.

Aiyedatiwa called for an end to what he termed needless crisis in the SouthWest State.

According to him, he was saddened by the embarrassment and discomfort due to barrage of negative news over the crisis in the last few months.

The Deputy Governor said there were no issues between him and the Governor but political actors capitalised on his boss’s absence to create a crisis for their selfish interests.

Ondo Assembly Proceeds With Impeachment Of Deputy Governor

Following the expiration of the seven-day ultimatum given to the Ondo state deputy governor, Lucky Aiyedatiwa, to respond to the allegations of gross misconduct, the state house of assembly will reportedly be proceeding with the impeachment proceedings against him.

This is in spite of a court order barring the house from carrying out the impeachment proceeding pending the determination of a lawsuit filed by Mr Aiyedatiwa.

The house which has now reacted to the court order, stated that the judiciary cannot stop the exercise as it is protected by the Nigerian Constitution against the interference of courts.

The House also responded to another suit filed by Mr Aiyedatiwa before the State High Court by describing the suit as an abuse of court process.

Speaker of the house, Olamide Oladiji who spoke at plenary on Tuesday, October 3, said;

The impeachment process will continue in line with the 1999 Constitution since the deputy governor failed to respond within seven days stipulated by the law.”

He issued a fresh directive to the Chief Judge of Ondo State, Olusegun Odusola, to “immediately” set up a seven-person panel to investigate the allegations levelled against the deputy governor.

Mr Odusola is joined in the suit filed by the deputy governor at the Federal High Court in Abuja.

Ondo Deputy Gov, Aiyedatiwa Seeks Court Order To Halt Impeachment Plans

Ondo State Deputy Governor, Lucky Aiyedatiwa, has requested a court order to halt the impeachment proceedings against him by the State House of Assembly

Aiyedatiwa, in suit No. AK/348/2023, filed at the High Court in Akure on Monday, is requesting the court to, among other things, stop the House of Assembly from impeaching him because it is not competent.

In a letter dated September 25, 2023, from the Chambers of Ebun-Olu Adegboruwa (SAN) and Co. and delivered to the office of the Chief Judge of Ondo State, copies of the court processes were duly attached for the information of the Chief Judge.

Aiyedatiwa also sought orders of injunction to stop the House of Assembly from initiating, continuing, or proceeding with the process of his removal from office as the Deputy Governor of Ondo State.

He is also praying the court stop the Chief Judge of Ondo State from accepting or acting upon any request from the House of Assembly of Ondo State to set up any panel to investigate any acts of gross misconduct against the Deputy Governor.

According to him, the impeachment move is in breach of his constitutional and fundamental rights to fair hearing and that the sacking of his media aides and subjecting him to the Ministry of Information headed by a Commissioner amounts to a breach of his rights and privileges as a Deputy Governor.

The Ondo deputy governor is also seeking a declaration that his office, tenure, status, rights and privileges are protected, guaranteed and secured by the Constitution, and the declaration that in the determination of his civil rights and obligations as a Deputy Governor of Ondo State by the House of Assembly, he is entitled to a fair hearing and that given the utterances and conduct of the House of Assembly so far, there is likelihood of bias against him in the impeachment process.

Aiyedatiwa accused the House Assembly of constituting itself into accuser, investigator, prosecutor and judge while berating them for conducting media trials against him without serving him with any notice of gross misconduct.

In the affidavit in support of the originating summons, it was stated that the House of Assembly embarked upon a media trial of the Deputy Governor purely to scandalize him and incite public opinion against him when indeed, no notice of acts of alleged gross misconduct was served on him.

Named as defendants in the suit filed by Ebun-Olu Adegboruwa, SAN, are the Ondo State Government, the Governor of Ondo State, Ondo State House of Assembly, the Speaker of Ondo State House of Assembly, the Clerk of Ondo State House of Assembly and Chief Judge of Ondo State.

In the Originating Summons, the Deputy Governor is seeking the following reliefs:

“A. A DECLARATION that the office, tenure and status of the Claimant as the Deputy Governor of Ondo State are creations and establishment of the Constitution by virtue of Sections 186 and 187 of the Constitution, Federal Republic of Nigeria, 1999 (as Amended) and the same cannot be tampered with, altered, shortened, withdrawn or jeopardized by the Defendants except and in a manner permitted by law.

”B. A DECLARATION as the Deputy Governor of Ondo State, the office, tenure, status, rights and privileges of the Claimant are protected, secured, guaranteed, governed and regulated under and by the relevant provisions such as sections, 188, 189, 190 and 191 of the Constitution, Federal Republic of Nigeria, 1999 (as Amended) and they are to be enjoyed by the Claimant without let or hindrance from the Defendants except and in a manner permitted by law.

”C. A DECLARATION that as the Deputy Governor of Ondo State, the Claimant is entitled to the rights and privileges attached to his office, including but not limited to his media details and other aides attached to his office.

”D. A DECLARATION that in the determination of his civil rights and obligations as the Deputy Governor of Ondo State, the Claimant is entitled fair hearing from the Defendants, and the Defendants are not entitled to take any step or decision in violation of the Claimant’s right to fair hearing.

”E. A DECLARATION that the dismissal of all the media aides and press crew attached to the office of the Claimant as the Deputy Governor of Ondo State by the 1st and 2nd Defendants without prior notice to the Claimant is unreasonable, vindictive, malicious, unconstitutional, illegal and null and void.

”F. A DECLARATION that the Defendants are not entitled to arbitrarily, forcefully, illegally, unduly or in any other manner howsoever interfere with, encroach upon and/or infringe on the constitutional rights and functions of the of the Claimant as the Deputy Governor of Ondo State without due process of law as contained in the relevant provisions of the Constitution, Federal Republic of Nigeria, 1999 (As Amended).

”G. A DECLARATION that as a democratically elected Deputy Governor of Ondo State in a joint ticket with the 2nd Defendant, State, the Claimant is entitled to remain in office as such, freely exercise his rights and discharge his constitutional duties as Deputy Governor of Ondo State within the full time allocated to the office by the Constitution, Federal Republic of Nigeria, 1999 (As Amended).

”H. A DECLARATION that the Defendants are not entitled to take any steps in pursuit of the removal of the Claimant from his office as the Deputy Governor of Ondo State in flagrant violation of his constitutional and fundamental rights.

”I. A DECLARATION that the 3rd-5th Defendants are not entitled to constitute themselves into investigators, prosecutors and judge over trumped-up allegations against the Claimant in relation to his office, tenure and status as the Deputy Governor of Ondo State.

”J. A DECLARATION that the 6th Defendant, the Honourable Chief Judge of Ondo State, is not entitled to receive, act upon and/or consider any request from the 3rd – 5th Defendants for the purpose of constituting a panel to investigate any purported allegation and/or for the removal of the Claimant from office as Deputy Governor of Ondo State in violation of the constitutional and fundamental rights of the Claimant.

”K. INJUNCTION restraining the Defendants and their agents, privies and representatives from interfering with, restricting, disempowering and/or preventing the Claimant from discharging his constitutional duties and functions as the duly elected Deputy Governor of Ondo State in a joint and equal ticket with the Governor of the Ondo State.

”L. AN ORDER forthwith reinstating/restoring the full and total rights and privileges attached or accruing to the office of the Claimant as duly elected Deputy Governor of Ondo State which include, but not limited to the restoration of all media aides and press crew attached to the office of the Claimant as Deputy Governor of Ondo State.

”M. AN ORDER setting aside any purported process or notice of any allegation of Gross Misconduct against the Claimant on the ground that such process or notice is a violation of Section 188 of the 1999 Constitution of the Federal Republic of Nigeria.

”N. SUCH FURTHER OR OTHER ORDER (S) as this Honourable Court may deem fit to make in the circumstances.
